Chapter I. General Provisions
These regulations are formulated in accordance with the “Education Law of the People's Republic of China”, the “Higher Education Law of the People's Republic of China”, “Several Provisions on the Campus Order Management of Regular Colleges”, “University Student Code of Conduct”, “Provisions on the Administration of Students in Regular Colleges” and other related provisions taking into account the facts of the College, with a view to maintaining good order and discipline in the College, to establish an excellent learning and living environment and to facilitate the healthy growth of the students.
The regulations apply to all students in the College, including all undergraduates, exchange students, international students, concessional students and master degree candidates who have officially registered for study in the College.
A student who violates any provision shall be given disciplinary action in accordance with this regulation. The regulations cover internships, field work and other officially sanctioned college activities.
The Student Disciplinary Committee (hereinafter referred to as the “SDC) may recommend such action as:
4.1 Oral warning (with written records) (duration: 6 months);
4.2 Written warning (duration: 6 months);
4.3 Serious written warning (duration: 6 months);
4.4 Demerit recording (duration: 12 months);
4.5 Academic Probation (duration: 12 months);
4.6 Academic Dismissal;
4.7 Other disciplinary actions decided by the SDC.
Any student who violates the laws or regulations of the state or local government shall, in light of the circumstance, be given appropriate disciplinary action:
5.1 For violation of the laws or regulations of the state or local government and has been found in violation by the judicial or public security department but has not been imposed any punishment, he shall be given the disciplinary action of a demerit or below;
5.2 For violation of the “Regulation on the People's Republic of China on Administrative Penalties for Public Security” and has been punished by the public security department, he shall be given the disciplinary action of a demerit or above;
5.3 For violation of the provisions of the state and has been given the criminal penalties, he shall be given the disciplinary action of academic probation or above;
5.4 For violation of the provisions of the constitution law and has disturbed the social order, he shall be given the disciplinary action of academic probation or above.
Any student who has been subject to disciplinary action shall be liable to the following action at the same time:
6.1 Disqualification from honors, awards or scholarship in the college or division during the
relevant term in the current academic year;
6.2 If there are any other provisions, the latter shall prevail;
6.3 Upon the expiry of the relevant term, the student may apply to SDC for revocation of the said penalty. SDC shall have the absolute discretion to revoke the said penalty on the base of his/her performance during the observation period.
A student who violates the provisions of the College but honestly tells the truth and causes no damage shall be given lenient punishment.
A student who violates the provisions of the College and involves the following circumstances shall be given a severe punishment, for which two demerits may result in suspension of study, and three demerits may result in dismissal from the College:
8.1 Resorting to retaliation or threat to others;
8.2 Repeated offence;
8.3 Violation in collusion with outside ;
8.4 Violations relating to foreign nationals;
8.5 Other similar circumstances deserving severe punishment.
Authority, Procedure and Management in Disciplinary Action
9.1 Disciplinary actions of oral warning(with written record), written warning, serious written warning, demerit recording shall be verified by the hostel councilors and put forward by the SAO, then submitted for approval by the chairman of the SDC, and finally filed by the SAO for record;
9.2 Disciplinary actions of academic probation shall be verified by the SAO and the security office and then put forward the initial opinion for disposal, then commented by the chairman of the SDC, and finally submitted to the SDC for decision;
9.3 Disciplinary actions of academic dismissal shall be verified by the SAO, the security office and other relevant departments and then put forward the initial opinion for disposal, then commented by leaders of two departments, and finally submitted to the SDC for decision;
9.4 The Security Office shall assist an administrative unit to investigate related violations and submit findings to the unit for appropriate action;
9.5 Complicated cases should be reported directly to the public security department for disposal and the security office shall provide assistance;
9.6 For those violation cases with clarified facts, the SAO, AR or Security Office shall make the decision or put forward the opinion for action within one month after they receive the relevant materials or notices. Otherwise, the SDC shall directly take action after the time limit; in addition, the responsible people concerned in the relevant administrative departments shall bear their own responsibilities;
9.7 Under special situations, the chairman of SDC has the right to authorize SAO, AR or Security Office to take the disciplinary action of demerits or below directly;
9.8 If any student has been given penalty of written warning or above, the related departments shall keep the relevant decision and the materials relating to revocation of penalty in its record, and incorporate into student’s personal files; if any student has been given the penalty of oral warning (with written record), the related departments shall the relevant decision and the materials relating to revocation of penalty in its record;
9.9 Academic probation shall be no more than one year. Any student who has been given the disciplinary action of academic probation shall be under the inspection of the department which he belongs to or the hostel mentor. During the period of academic probation, if the student has been found to repent and make progress, the academic probation may be
terminated as scheduled. If he makes prominent contribution, the academic probation may, upon the application of the student, after verification by the department which took such disciplinary action and the approval by the College, be terminated ahead of time. (The probation period should not be less than six months.); If the student does not show any repentance after education or violates the provisions again during the probation period, he shall be given the disciplinary action of academic dismissal. Normally, the academic probation shall not apply candidates for graduation;
9.10 Any student who has been given academic dismissal shall complete the clearance procedures for leaving College within one week. Otherwise, the College shall have the right to dispose of their personal belongings in the hostel and the relevant expenses charged to the student.
After the disciplinary decision has been made, the responsible department shall deliver the decision to the student. If the student refuses to sign, or cannot sign due to special reasons, the person delivering the decision shall record the situation. In case the decision cannot be delivered, the department shall publicize the decision and shall report the case to AR, SAO or Security Office for record.
Any disciplinary decision shall be publicized timely within the college, division or programme as appropriate, and the students’ parents should be informed in writing. In case the action involves personal privacy or state security, the SAO shall decide whether the decision should be publicized or not.
The student shall have the right to appeal in writing to the Student Disciplinary Appeal Committee within 10 calendar days after receiving the disciplinary decision made by the Senate. The Student Disciplinary Appeal Committee shall make a recommendation on the appeal to the Senate upon investigation. This Senate decision shall be made known to the student within 15 calendar days of receipt of the written application of appeal by the Student Disciplinary Appeal Committee. Such decision shall be final. When a decision cannot be made on the appeal within 15 calendar days because of complicated cases, further extension of 15 calendar days can be granted and is subject to the approval of the President or Vice President (Academic).
During the period of appeal, the Student Disciplinary Appeal Committee can recommend the suspension of the enforcement of the disciplinary decision, if necessary.
If the student does not agree with the final Senate decision on his appeal, he can lodge a further appeal in writing to the Department of Education of Guangdong Province within 15 calendar days of his receipt of the final Senate decision.
Chapter II.Disturbance on Campus
Any student who hurls invectives, insults or slanders on other people or infringes upon personal privacy of others and thus causes bad influence shall be given the disciplinary action of oral warning or written warning. In case the circumstance is serious, he shall be given the disciplinary action of a demerit or above, and even academic dismissal.
A student who poses threats on others’ safety directly or by means of letters, phone calls or emails and thus disturbs others’ normal life shall be given the disciplinary action of oral warning or written warning. In case the circumstance is serious, he shall be given a demerit or above and even academic dismissal.
Any student who peeps or acts indecently against other people in bathrooms or toilets shall be given written warning or a demerit. In case the circumstance is serious, he shall be given the disciplinary action of academic probation or dismissal.
Any student who conducts sexual harassment through language, words, or behaviors shall be given the disciplinary action of oral or written warning. In case the circumstance is serious, he shall be given a demerit or above and even academic dismissal.
A student who deliberately conceals, destroys, disposes others’ notices, documents, posts or emails etc. shall be given the disciplinary action of oral or written warning. If heavy losses are caused, he shall be given the disciplinary action of a demerit. In case the circumstance is serious, he shall be given the disciplinary action of academic probation or dismissal.
Chapter III.
Infringement on Private or Public Property or Intellectual Property
Any student who steals, extorts, defrauds, or falsely claims the properties of others shall be given disciplinary action in the light of the seriousness of the circumstances:
19.1 If the involved amount is RMB 200 or below, he shall be given an oral warning or written warning;
19.2 If the involved amount is more than RMB 200 and less than RMB 600, he shall be given written warning or a demerit ;
19.3 If the involved amount is more than RMB 600 and less than RMB 1000, he shall be given a demerit or academic probation;
19.4 If the involved amount is more than RMB 1000, he shall be imposed academic probation or dismissal.
Any student who deliberately conceals, destroys or destroys the properties of others shall be given the disciplinary action of oral or written warning. In case the circumstance is serious, he
shall be given a demerit or above or even academic dismissal.
Any student who is guilty of the following acts shall be given the disciplinary action of written warning or a demerit. In case the circumstance is serious, he shall be imposed academic probation or dismissal:
21.1 Deliberately destroying or damaging public buildings, hostel facilities or public facilities in the college;
21.2 Privately transforming or decorating public buildings, hostel facilities or public facilities in the college without approval.
Any student who deliberately destroys or damage the communication equipments such as campus TV, telephones, networks, etc. shall be given a demerit. In case the circumstance is serious, he shall be given the academic probation or dismissal.
Any student who violates the operational instructions of fire prevention or fire control equipments and causes property losses for the state, the college, or other people shall be given the disciplinary action of oral or written warning. If the circumstance is serious, he shall be given a demerit or academic probation.
Any student who is under any of the following situations shall be given the disciplinary action of written warning or a demerit. In case the circumstance is serious, he shall be given academic probation or dismissal:
24.1 Privately transferring or permitting intellectual properties of the college without approval;
24.2 Violating the provisions related to confidentiality and divulging scientific research achievements, including the technology secrets;
24.3 Other violations of provisions on intellectual properties of the college and thus causing the loss to the rights and interests of the college.
Any student who violates the provisions governing computer and network management shall be given the following disciplinary actions:
25.1 Modifying, moving, destroying, copying, and downloading the files or information from the computers of other persons or organizations without permission, he shall, in light of the losses thus caused, be given the oral warning or written warning, in case the circumstance is serious, he shall be given a demerit or academic probation;
25.2 Creating, deliberately spreading or using the computer virus, or illegally trespassing on the computer system of other person or organizations. He shall, in light of the losses thus caused, be given the written warning or demerit recording, in case the circumstance is serious, he shall be given academic probation or dismissal;
25.3 Opening the proxy or ftp service without permission or stealing the accounts or passwords of other people or organizations and thus causing bad influences. He shall be given oral warning or written warning. In case the circumstance is serious, he shall be given a demerit or academic probation.
Any student who is under any of the following situations shall be given the disciplinary action of oral warning or written warning. In case the circumstance is serious, he shall be given a demerit or academic probation:
26.1 Showing no respect to, or abusing, insulting or slandering the teaching staff in the college;
26.2 Fabricating news or spreading rumors and thus causing bad influences;
26.3 Disseminating pornographic materials such as books, pictures, audios, video or websites;
26.4 Engaging in illegal business and thus causing bad influences and disregarding dissuasion;
26.5 Involving in pyramid sale and disregarding dissuasion;
26.6 Violations of the social morality and thus causing bad influences.
Chapter IV.Supplementary Provisions
The terms “above” or “below’ as mentioned in this document relating to disciplinary actions shall include the given level.
The SDC has the right to interpret the provisions of these regulations.
The regulations shall be effective as of Sep. 1, 2017.
